These terms govern every purchase from USAFoam.co. Approved credit accounts are additionally governed by the signed Customer Agreement and credit application, which control if they conflict with these terms.
1. Who we sell to
USAFoam.co sells spray polyurethane foam (SPF) products, equipment, and jobsite supplies to professional installers and contractors. By placing an order you represent that you are purchasing for business use in a professional capacity, not as a consumer for household use.
2. Orders and acceptance
An order placed on this site is an offer to purchase. We accept it when we confirm the order and begin fulfillment. We may decline or cancel an order — for example when stock is unavailable, a price was listed in error, or payment cannot be verified — in which case anything you have paid for that order will be refunded in full.
3. Pricing
Listed prices are in U.S. dollars and may change without notice. Contractor pricing, state-specific pricing, and customer-negotiated rates apply only to the signed-in account they were set for. Taxes are calculated at checkout; where an estimate is shown, the final invoice reflects the authoritative tax calculation. Obvious pricing errors do not bind us, even after confirmation — we will contact you with the corrected price before proceeding.
4. Payment
Card and online payments are processed by Stripe; we never see or store your card number. Approved accounts may purchase on NET-30 credit terms as set out in the signed Customer Agreement and credit application. NET-30 credit is underwritten by an independent credit agency. Credit purchases require the account to be in good standing — overdue balances suspend credit checkout until brought current. Invoices for credit purchases are due within 30 days of the invoice date. Accounts more than 30 days past due will be turned over to a third-party collection agency, and the referral is reported to commercial-credit bureaus.
5. Title and risk of loss
For pickup orders, title and risk of loss pass to you when the goods are handed over at the branch counter. For delivered orders, title and risk of loss pass on delivery to the address you provided. Inspect every order at handover and note any damage or shortage at that time.
Unloading on delivered orders: liftgate service lowers palletized goods to ground level at the vehicle — the carrier does not move goods beyond that point and drivers do not hand-lift items over 50 lbs or operate customer equipment. Without liftgate service, you are responsible for unloading the vehicle and confirm at checkout that a forklift or loading dock is available on site. If the vehicle cannot be unloaded on arrival, any additional carrier fees, wait-time charges, or re-delivery charges billed to USAFoam are passed through to you at cost.
6. Product use and safety
SPF chemicals and application equipment are professional products. You are responsible for using them in accordance with the manufacturer's instructions, applicable safety data sheets (SDS), required personal protective equipment, and all applicable laws, codes, and jobsite regulations. Technical guidance from our team is offered in good faith but does not replace the manufacturer's documentation.
7. Warranties
Products carry the manufacturer's warranty, which we pass through to you where permitted. Except as expressly stated, products are provided as-is and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the maximum extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of an order is limited to the amount you paid for the products giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, project delays, or rework costs.
9. Returns
Returns cannot be initiated through the website. All returns are handled by dispatch, case by case, and require prior authorization — see the Returns page. Opened chemical containers and special-order items are not returnable.
10. Governing law
These terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Any dispute may be heard in any state or federal court located in Fairfield County, Connecticut, and you consent to the jurisdiction and venue of those courts.
11. Changes
We may update these terms from time to time. The version posted at the time you place an order applies to that order.
